These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://www.elitefloorsolutions.com (the “Site”) operated by Elite Floor Solutions (“Elite Floor Solutions,” “EFS,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use the Site.

1. Scope of These Terms

These Terms apply to your use of the Site and any related online content, including informational pages, lead and quote request forms, promotional materials, and links to third-party tools.

These Terms do not govern the installation of flooring systems, warranty coverage, payment obligations, or any other aspects of contracting work performed by Elite Floor Solutions. All contracting work is governed exclusively by the written Standard Service Agreement (SSA) executed between Elite Floor Solutions and the customer at the time the work is contracted. In the event of any conflict between these Terms and a signed SSA, the SSA controls as to the subject matter of that agreement.

Elite Floor Solutions serves East Tennessee, North Georgia, and Western North Carolina.

3. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, videos, product and system names, and the overall look and feel, is the property of Elite Floor Solutions or its licensors and is protected by United States and international intellectual property laws. These Terms do not transfer to you any ownership or license to any of our or our licensors’ intellectual property, and all right, title, and interest in and to such property remain solely with Elite Floor Solutions and its licensors.

You may not copy, reproduce, republish, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

4. Lead and Quote Request Forms

The Site allows you to request a quote or contact us by submitting information through online forms, which may include your name, phone number, email address, project address, and details about your project. By submitting information through the Site, you represent that the information you provide is accurate and that you are authorized to submit it.

You agree that Elite Floor Solutions and its authorized representatives may contact you by phone, text message, and email using the contact information you provide, including for the purpose of responding to your inquiry, scheduling estimates, and providing information about our products and services. Standard message and data rates may apply. You may opt out of marketing communications at any time by replying STOP to text messages, using unsubscribe links in emails, or contacting us directly.

5. Promotions and Pricing on the Site

Any information on the Site regarding products, systems, pricing, timelines, or performance is general in nature and does not constitute a binding representation or warranty. Product performance depends on site conditions, preparation, use, and maintenance. Binding warranty terms for installed flooring systems are set forth in the Standard Service Agreement.

10. Limitation of Liability

To the fullest extent permitted by law, Elite Floor Solutions, its owners, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of the Site, whether based in contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to your use of the Site shall not exceed one hundred U.S. dollars ($100.00). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Elite Floor Solutions and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

12. Termination

We may suspend or terminate your access to all or any part of the Site at any time, with or without cause or notice, effective immediately. If you wish to stop using the Site, you may simply discontinue doing so. Provisions of these Terms that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

13. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or your use of the Site are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. The exclusive venue for any such dispute shall be the state and federal courts located in Bradley County, Tennessee, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will post the updated Terms on the Site and update the “Last Updated” date below. Material changes will take effect on the date posted, or on such later date as we may specify. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with any documents expressly referenced herein (including the Privacy Policy and any applicable SSA), constitute the entire agreement between you and Elite Floor Solutions regarding your use of the Site.
